The contract
A contract for the provision of the booked track day and rally event will only be concluded upon receipt of confirmation from Spa Revival srl that your booking has been accepted. Once your booking has been accepted, a legally binding contract exists between us.
Price and payment
The price of the track day and rally event will be as advertised on the website or in promotional literature. Spa Revival srl reserves the right to change the price at any time prior to acceptance of your reservation. In such circumstances, you will have the right to cancel your reservation and receive a full refund. Unless otherwise agreed by us, full payment for the track day and rally event must be made by bank transfer. In any case, payment must be received at least 40 days before the track day and rally event.
Privacy policy
Spa Revival srl is committed to protecting the privacy of its customers and visitors to our website.
Spa Revival srl may collect certain personal data, the use of which is subject to Belgian law (Law of December 8, 1992 on the protection of privacy).
This information will only be used to contact you and provide you with the requested information or to deliver the purchased products and/or services, if possible. Your personal information will not be shared with third parties, unless required by law. In general, using the Spa Revival srl website does not require you to provide any personal information.
However, you may choose to provide such information by filling in the "subscribe to newsletter" form or by booking your participation in one of our events.
The information we collect is used solely to contact you about the products and services you have purchased or, if possible, to send you the information you have requested about our company and its activities. As is now commonplace with most websites, our site uses cookies to record certain information about your use of the site, such as your preferred language.
Cookies are small data files that can be placed on your computer's hard disk. The information obtained is used anonymously and in aggregate, and you cannot be identified. You are not obliged to accept any cookie we send you, and you can in fact modify your browser settings so that it does not accept cookies.
The information we collect is confidential and is never passed on to third parties, unless we are legally obliged to do so. You have the right to request a copy of your personal information and to have it corrected or deleted from our files. Requests should be sent to Info@sparevival.com
Right to cancel
You can cancel your booking by informing us in writing or by e-mail at any time up to 40 days before the track day and rally event. In this case, we will refund any booking fees paid as follows:
If we receive notice of cancellation more than 40 days before the track day, you will receive a full refund of all monies paid.
If notice of cancellation is received between 40 and 30 days before the track day, you will receive a 50% refund. If notice of cancellation is received between 30 and 15 days before the track day, you will receive a refund of 30% of the total price. Once accepted by us and unless otherwise stipulated in these conditions, in the event of cancellation less than 15 days before the track day and rally event, the fee will remain at 100% of the booking fee.
Cancellation due to a technical problem with your car and/or personal illness will be subject to reimbursement under the same conditions as above.
Cancellation on our part
We reserve the right to cancel the contract at any time between us if:
(a) the number of bookings taken is not sufficient to justify the continuation of the track day and rally event; or
(b) the track used by us cancels or significantly alters the services offered to it; or
(c) any other matter beyond our reasonable control arises.
We will endeavour to give as much notice as possible in the event of cancellation and, if cancelled, any booking fee will be refunded to you in full or, alternatively, we will offer you, where possible, alternative dates or venues. Under no circumstances will we be obliged to offer additional compensation for disappointment.
Covid19 - Spa Revival Statement
We want to offer our customers the opportunity to participate in our events in the best possible way and we will do our best to ensure that they can. We reserve the right to cancel your participation only in the event that the event and its organization are affected by additional security measures against Covid-19 implemented by local authorities, including restrictions, bans, border closures or similar. In this case, you will be contacted as soon as possible. If the event is cancelled, your booking fee will be fully refunded, or alternatively, we can offer you other potential dates or venues. Please note that, in all cases, Spa Revival srl will not be obliged to offer any additional compensation for any potential loss that is not related to the event booking fee.
Operational procedures and specific track requirements
Track days and rally events can be dangerous, and your attention is specifically drawn to our PRACTICE section on our website. You should read the published documents PREPARATION, TRACK DAY AND RALLY RULES AND BEHAVIOR and DISCHARGES before making any bookings. Failure to comply with Track Day rules on the day may result in your inability to use the circuit, and in such circumstances we will not be obliged to offer compensation.
In addition, you, your passengers and your vehicle must comply with all rules and regulations imposed by the circuit (e.g. noise limits in dB). You will also be required to sign a waiver. Again, we will not be obliged to offer compensation if the circuit, at its absolute discretion, refuses to allow you, your passengers or your vehicle onto the track.
Limitation of liability
We shall have no liability to you for any failure to honour or delay in your booking caused by any event or circumstance beyond our reasonable control, including, without limitation, strikes, lockouts and other industrial disputes, systems failure or flood, fire, explosion or accident. In particular, no refund (whether for travel expenses or the cost of the track day) will be made in the event of the track being unusable due to adverse weather conditions or other circumstances beyond our reasonable control. Similarly, we will not be liable if travel delays result in late arrival or no arrival at all at the runway. No refund (whether for travel expenses or the cost of the track day) will be made in the event of you or your vehicle being declared unfit to use the track, and you are referred to our operating procedures regarding the specific regulations that apply. Vehicles travelling at high speeds can be dangerous, and under no circumstances will we be liable for any damage caused to a vehicle or other property. Therefore, if you are concerned about your vehicle or your liability to third parties, you should ensure that it is insured for track use. Unless otherwise required by law, we will not be liable to you for any indirect or consequential loss, damage or expense (including loss of profits, business or goodwill) howsoever arising and we will have no obligation to pay any money by way of compensation. Nothing in these terms and conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights which cannot be excluded, nor to exclude or limit in any way our liability to you for death or personal injury resulting from our negligence.
Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of these terms and conditions will not be affected.
Full agreement
These terms and conditions, together with our current rates, practical guidelines, track day rules and behaviour, booking form and contact details, constitute our entire agreement relating to the provision of the services we offer to you. Nothing that any salesperson may say on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature of the services offered by us. Except in the case of fraud or fraudulent misrepresentation, we shall have no liability for any representation that proves to be false or misleading.
Notice
All notices from you to us must be in writing and sent to our contact address at Spa Revival srl, Avenue de Spa 87, 4802 Heusy, and all notices from us to you will be sent by email or to the address shown on the booking form.
Applicable law
The contract between us shall be governed by and construed in accordance with Belgian law, and the Belgian courts of Liège shall have jurisdiction to settle any dispute between us.
